Perhaps the Risk Manager had a Compliance hat she wore when the occasion demanded. While there were compliance responsibilities with regard to medical records, they were mostly to do with ensuring that the all forms were completed (such as Operative Reports, or Discharge Summaries).In the late 1990’s, the trend toward digitization of electronic health records raised new health care compliance concerns: privacy and security. HIPAA, an act instituted in ’96, was not originally meant to deal with healthcare compliance directly. The focus was portability. The intent was to enable employees to move between jobs without losing their health insurance due to denials of enrollment by the new employer’s insurer due to preexisting conditions (in fact the legislation in essence, forbade denial of enrollment on the ground of preexisting condition, when an employee was hired by a subscribing company within a certain period of time). Yet, HIPAA lawyers (yes, the term was coined during this time) realized that health insurance companies had to perform certain actuarial calculations in order to assess risk and set premiums, and, to that end, they had to review the claims experience. The only practical way to do that was to review the codes used for those claims.The problem is that these codes are not standardized. Every state has their own set of codes. This incited aides to the Congress and Dept. of social services to create a single, unified set of claims codes. Yet, as with most things legislative, this begat another concern: with all this very sensitive information being transmitted on a regular basis, there was the potential for abuse if the patient data were to end up in the hands of those unauthorized to view it, and who would perhaps use it for non-benign purposes. As a result, DHHS allowed for comments about medical privacy issues. They received nearly 40,000 comments about health information that had been mishandled with regard to its privacy. As a result of this massive inquiry, HIPAA privacy rules were established dealing with criteria and disclosure of medical information. Soon after, there were a number of rules instituted that dealt with the manufacturing of, the storage of, and the ultimate disclosure of protected health information. These six-hundred pages were the beginning of what has come to be known as HIPAA law.Since then those who know HIPAA law has become almost a cottage industry within the area of healthcare law. As Healthcare law has become more robust, and areas like healthcare compliance have been added, lawyers have had to learn more and more about the industry especially with regard to how changes affect security and privacy. Yet, as more and more health information was created, stored and transferred electronically, the hospitals and medical practices established many offices like the office for a position of Chief Information Security.This trend was given a significant boost in 2004, when President George W. Bush issued an Executive Order setting in motion a national transition to an interoperable electronic health record system by 2004. After Bush’s executive order was issued, Congress established funding to help with the transition. Hillary Clinton sponsored one of the first bills allotting funding. As a result of thin margins and slow reimbursement, a number regional hospitals were slow to adopt the new measures. This hurt national coordination efforts. Medicare stopped taking paper claims submissions, but there was still significant resistance among care givers to give up the pen and paper.In February, 2009 legislation was passed which would almost require every Risk Manager and Compliance Officer to have at least a rudimentary knowledge of HIPAA law, as it pertained to electronic health records. As part of the “Stimulus Package” Congress passed another law known by its acronym HITECH. In a reprise of the concerns which led to the implementation of the HIPAA Privacy and Security standards, HITECH did three things that will change the daily activities of Risk Managers, hospital counsel, Privacy Officers and IT and Security Officers. It provided for Thirty Billion Dollars in incentive payments to be used to accelerate the transition to an interoperative health record system. The law, enacted on Jan. 13,2010, establishes criteria for access to those funds, allowing only those who can exchange data in an accurate and secure manner. In addition to all that, the third way in which it affects the healthcare industry is that it requires that all information is accessible in a way that is consistent and buttressing old HIPAA privacy and security standards. Such a mandate is made even harder, however, by the fact that HIPAA rules were expanded and strengthened as a result of the act.As hospital staff are made aware of these new regulations, despite being in the middle of a recession, there is no doubt that lawyers will we be called upon by hospitals. Healthcare compliance will truly become HIPAA compliance.

Police called to investigate after tenant draws swastikas in landlord’s house

82-year-old Jewish Bowmanville, Ontario woman Ms. Marion Schwarz’s house has been found vandalized with graffiti showing neo-Nazism expressions, as well as swastikas. Broken windows and walls were found ripped open.

The terms “Kike”, “Fuck Jews,” and “White Power” were written in white around the house, as well as a large green swastika.

The woman’s husband Mr. Allan Schwarz, was returning home to their house on King Street East, the town’s center, to bring home a present for their 40th wedding anniversary when he found the house not the way he left it.

Bought to start an antique store, the Schwarz’s started a cattle business instead and later rented it out. Ten years ago their tenant started to rent the house, just five months ago he stopped paying rent saying he was on welfare. Ms. Schwarz offered to lower his rent. He vandalized and fled, with his son and daughter, from the house on Tuesday morning, the day he was to be evicted. She was accompanied by her son Alan, two police officers, and a locksmith.

“I don’t know what happened to him … Up until the last while, I never had a day’s trouble with him. He was friendly,” Ms. Schwarz said.

Durham Regional Police are now investigating what they refer to as an “incident”, and what lobby group B’nai Brith Canada has argued constitutes a “hate crime”.

“A swastika on its own, as per the Criminal Code of Canada, is not a hate crime,” said Sgt. Paul McCurbin. “It doesn’t have the proper components to be considered a hate crime. For example, if I said that I was going to kill a race of people or we should kill a race of people, that would be considered a hate crime.”

A local neighbor, who asked not to be named, swept glass from the broken windows off the sidewalk, worried that dogs could cut their feet. She said the tenants were private people.

A Prisoner of War (POW) camp was located in Bowmanville during World War II (WWII). [1] [2] Named Camp 30 it held captive German army officers from the Afrika Korps, fliers from the Luftwaffe and naval officers from the Kriegsmarine. Many of them were transferred from England. Among them was famous top U-boat ace of World War II Otto Kretschmer. He was involved in the Battle of Bowmanville.

The Bowmanville boys’ school was the building holding the prisoners. The facility had been designed to house 300 boys. Surrounding the existing school buildings was a barbed wire fence. It was not the typical POW camp, having good food and prisoners being well treated. It had gardens and even a swimming pool was built. Movies were shown each week, music concerts were held, and stage plays were produced.

Mr. Schwarz fled from Germany to Canada in 1938. Marion, a Toronto native, and her husband moved to Bowmanville to start a new life.

“In 1938, we found safe haven in Bowmanville,” said her son Alan. “It was wonderful place to settle and my parents have been here basically for 70 years. They never anticipated ever facing the same kind of symbolism they had to leave Germany for.”

The investigation still continues. The tenant’s name has not been released.

“We couldn’t foresee anything like this because human beings don’t do things like this.”

Indian Human Resources minister to reform technology sector

Kapil Sibal, India’s Minister of Human Resource Development (HRD) held a meeting Monday to present his reform plans for the Indian Institutes of Technology (IIT) sector by increasing the entrance percentage to 80% and above in the class XII (final year) board exams. A three-member committee was set up to review the proposal.

Sibal said, “The present criteria is that students need to secure 60% in class XII for appearing in IIT-JEE. This is not acceptable”, pointing out that the current criteria where students getting more than 60% in the board exam of the twelfth class are eligible for IIT-JEE is not good enough and that it has to be raised to 80-85%.

He also stated that students undervalue final year board exams, preparing instead for the Indian Institute of Technology Joint Entrance Examination (IIT-JEE); they enrol in coaching institutes and concentrate on their study material in order to enter IIT. He wants to abolish these “teaching shops.”

The meeting decided that they would set up two committees, one headed by Anil Kakodkar, Atomic Energy Commission (Chairman) and other by T. Ramasamy, Department of Science and Technology (Secretary). The first committee is scheduled to decide final year board percentage and the second one is scheduled to set the curriculum.

The Kakodkar committee also plans to decide how to abolish coaching institutes and how to move IIT field forward with a greater emphasis on research. The committee is expected to submit its report in the next six months. The minister also clarified that some of these will be implemented from the 2010 academic year and some from 2011.

The meeting was also expected to reduce the fee for African and South Asian Association for Regional Cooperation (SAARC) countries as their fees are higher than those of Indians. The review committee says that people of other countries are tempted to study in India but they refrain due to high fees. The Ramasamy committee is expected to submit its report in the next three months.

Lastly, the meeting said that it will appoint board members and directors on the basis of nominations and independent rank and power to ensure IIT’s activity.

Gastric bypass surgery performed by remote control

A robotic system at Stanford Medical Center was used to perform a laparoscopic gastric bypass surgery successfully with a theoretically similar rate of complications to that seen in standard operations. However, as there were only 10 people in the experimental group (and another 10 in the control group), this is not a statistically significant sample.

If this surgical procedure is as successful in large-scale studies, it may lead the way for the use of robotic surgery in even more delicate procedures, such as heart surgery. Note that this is not a fully automated system, as a human doctor controls the operation via remote control. Laparoscopic gastric bypass surgery is a treatment for obesity.

There were concerns that doctors, in the future, might only be trained in the remote control procedure. Ronald G. Latimer, M.D., of Santa Barbara, CA, warned “The fact that surgeons may have to open the patient or might actually need to revert to standard laparoscopic techniques demands that this basic training be a requirement before a robot is purchased. Robots do malfunction, so a backup system is imperative. We should not be seduced to buy this instrument to train surgeons if they are not able to do the primary operations themselves.”

There are precedents for just such a problem occurring. A previous “new technology”, the electrocardiogram (ECG), has lead to a lack of basic education on the older technology, the stethoscope. As a result, many heart conditions now go undiagnosed, especially in children and others who rarely undergo an ECG procedure.

UK seeks pardon for executed World War I soldiers

The UK Defence Secretary Des Browne has announced a plan to seek approval from Parliament to grant a group pardon to more than 300 British soldiers executed during the First World War for offences such as cowardice and desertion.

The proposed pardon will include the case of Pte. Harry Farr, whose family had appealed to the Defence Secretary to grant a full, posthumous pardon. The Ministry of Defence informed the family lawyers of the decision hours before making a public announcement.

Farr’s family members said in a statement that they were “overwhelmed”.

The government proposes to pardon all those executed in World War I under the Army Act 1881 and the Indian Army Act 1911, for what are considered “battlefield offences”, such as cowardice or desertion, which may have been influenced by the stress of the battle. The proposal involves several Commonwealth and former colonial countries whose troops also fought alongside British troops. Mr. Browne said that he intends to introduce a suitable amendment to the current Armed Forces Bill to request Parliament’s approval.

Announcing the plan, Mr. Browne said, “I am conscious of how the families of these men feel today. They have had to endure a stigma for decades. […] I believe it is appropriate to seek a statutory pardon.”

Caroline Kennedy drops bid for New York Senate seat

Caroline Kennedy, considered to be among the front-runners for the United States Senate seat vacated by Secretary of State Hillary Clinton, yesterday withdrew her name from consideration for the seat. New York state Governor David Paterson had been reported as intending to name her as Clinton’s replacement this Saturday.

Caroline Kennedy, the only surviving child of former U.S. President John F. Kennedy, issued a statement at midnight saying she had quit her bid because of “personal reasons”.

A close associate of Kennedy, who spoke under the condition of anonymity, said that the decision was not related to the recent health issues of Senator Ted Kennedy (D-MA), Caroline Kennedy’s uncle. The senator suffered a seizure Tuesday while attending a luncheon with the newly inaugurated U.S. President Barack Obama in the U.S. Capitol in Washington, D.C.. He was rushed out of the event in a wheelchair and taken for treatment to Washington Hospital, where he remains. In May 2008 he was diagnosed with brain cancer, which required an operation.

The New York Post has reported that Kennedy withdrew her bid because Paterson was not going to choose her for the position. Citing the anonymous source, the Post said that “her poor performances in media interviews and in private sessions with various officials” is Paterson’s reason for not appointing her to the position. Paterson will reportedly make his decision by Saturday, January 26.

New York Attorney General Andrew Cuomo is the highest-profile candidate still up for consideration for the last two years of Clinton’s term. Cuomo, who has not commented on this recent turn of events, was the housing secretary during former President Bill Clinton‘s time in office, and in his current role as attorney general has overseen nation-wide reforms for student loans and participated in limiting Wall Street corporate spending.
